New York recently granted marshmallows tax-free status. Previously, the treats were subject to sales tax because they were considered candy.
In an example of the lack of logic inherent in much of tax law, mini-marshmallows and Marshmallow Fluff® have always been exempt from sales tax, as they are classified as food. Yet, as some argue, they are made of the exact same ingredients.
The New York Legislature recently debated the issue and decided large marshmallows should be considered food, and therefore tax-free.
Who says these legislators don't earn their big bucks?
